DL Suspension Procedures
In general, if you are facing a Drivers License Suspension, it is because you operated a motor vehicle in a manner or at a time when you were not supposed to. Maybe you did not know you couldn’t drive. Maybe you never received notice of your license’s ineligible status. THAT’S OK!! If you contact us within the time allowed under the law to request a hearing for you, then we can help you keep your license in most cases.
The laws concerning the suspension of your license can be confusing but to put in a nutshell here is how the process works:
• You are accused of operating a motor vehicle on a public road when your license was invalid or your driving privilege was suspended (Heck! You probably didn’t know you couldn’t drive anyway!)
• You receive a letter from the Texas Department of Public safety warning you that your license will be suspended
• You have 20 days to make a written request for a DL Suspension hearing or your license will be suspended for a definite period of time.
• You contact our office (within the time allotted of course) and we make the request for you.
• DPS sends us notification of a hearing date and time, which we notify you of as well.
• Prior to the hearing date, DPS usually sends us a copy of your driving record along with the petition they filed with the court to suspend your license.
• We attend the hearing, usually without your presence needed, and discuss the case with DPS and the presiding judge.
• In most cases, your license will not be suspended or you will be placed on probation for a short period of time where, if you receive no new tickets, your license will not be suspended.
